The Roosevelt County Commission met in regular business meeting Tuesday, October 2, 2018, at 9:00 a.m. in the County Commission Room in the Roosevelt County Courthouse with those present being: Commissioner Paul Grider, Commissioner Gene Creighton, Commissioner Dennis Lopez, County Manager Amber Hamilton, Chief Deputy Clerk Stephanie Hicks, County Attorney Randy Knudson, Treasurer Layle Sanchez, Special Project Coordinator Carol Acosta-Flores, Human Resources Administrator Debra Olds, Sheriff Malin Parker, Lieutenant Javier Sanchez, Deputy David Meeks, Road Superintendent Ricky Lovato, GIS Technician Johnny Montiel, RCCDC Director Bill Hendrickson, Durwood Dixon, CEO Roosevelt General Hospital Kaye Green, Doug Stone and Eastern New Mexico News Staff Writer Jamie Cushman. Absent was Commissioner Matthew Hunton and Commissioner Lewis Shane Lee.

Approval of Agenda:
Motion to approve agenda was made by Commissioner Gene Creighton with a second from Commissioner Dennis Lopez. Commissioner Paul Grider – Yes, Commissioner Gene Creighton – Yes, Commissioner Dennis Lopez – Yes.

Approval of Minutes:
Motion to approve minutes of the September 11 regular meeting and September 17 special meeting was made by Commissioner Dennis Lopez with a second from Commissioner Paul Grider. Commissioner Paul Grider – Yes, Commissioner Gene Creighton – Yes, Commissioner Dennis Lopez – Yes.

Elected Officials/Department Heads Report:
Sheriff – Sheriff Malin Parker has a meeting with General Nava on October 22, 2018 and invited any commissioners, county manager and attorney to attend with him. County Manager Amber Hamilton said she would attend the meeting and report back to the commission. He reported they are reworking some policies and procedures. Deputy David Meeks explained the need for an Evidence Technician. This would be a civilian who would check evidence in and out, as well as be responsible for researching retention and destruction information on old evidence.
They would also receive and catalog new evidence, and be the one to testify in court on behalf of the evidence. This would free up other deputies from being involved in the chain of custody.
Treasurer – Treasurer Layle Sanchez reported the tax sale was held September 19 for the fifteen, 2014, delinquent properties. Properties sold for a total of $53,200 with the state receiving $3,697, the county receiving $3,475 and excess total of $46,027.
Grants/HCAP – NONE
Road – Road Superintendent Ricky Lovato reported that S RR U is almost completed and that S RR W is in progress. His crew will be taking a short break from S RR W to take care S RR 4. A crew is working diligently working on shredding and with help from RCDC they will be cutting trees this week. 2 old stop signs will be removed from S RR 7, at the intersection of S RR 7 and S RR S, to be followed by new signage. This intersection will no longer be a 4 way stop.
Manager – County Manager Amber Hamilton asked the commission to move the November 6, 2018 Commission Meeting to November 9 due to the general election on the 6th and to be able to conduct the election canvass on the 9th. She reported that herself, GIS Technician Johnny Montiel and Special Project Coordinator Carol Acosta-Flores presented the county’s CDBG presentation. The county was not awarded the grant, however with a few modifications to the presentation they will be ready for the next application process. The road department and RCDC is having trouble keeping a full staff, in efforts to fill the void, the HR department will be looking for temporary workers for various positions. The auditor will be on site next week.

Resolutions – Ordinances – Proclamations:
a. Consideration of Resolution 2018-36 Adopting the FY 2020-2024 Infrastructure Capital Improvement Plan for the Roosevelt County Senior Center Operated by La Casa de Buena Salud – Motion to approve was made by Commissioner Dennis Lopez with a second from Commissioner Paul Grider. Commissioner Paul Grider – Yes, Commissioner Gene Creighton – Yes, Commissioner Dennis Lopez – Yes.
b. Consideration of Resolution 2018-37 Authorizing Publication of Notice of Consideration of Ordinance 2018-02 Amending Ordinance 2017-02 – RGH CEO Kaye Green reported the 20 year sunset is not sufficient and asked for the GRT sunset be extended to 2047. This would allow for a bond issue to cover expansion of the emergency room and operating rooms. This notice is the first step in the process. Motion to approve was made by Commissioner Dennis Lopez with a second from Commissioner Gene Creighton. a. Request for Approval of Contract Renewal Levacy Trucking for Hauling Road Materials – Motion to approve was made by Commissioner Dennis Lopez with a second from Commissioner Gene Creighton. Commissioner Paul Grider – Yes, Commissioner Gene Creighton – Yes, Commissioner Dennis Lopez – Yes.
b. Request for Approval of Contract Renewal with Red Rock Oil Company for Diesel Fuels – Motion to approve was made by Commissioner Dennis Lopez with a second from Commissioner Gene Creighton. Commissioner Paul Grider – Yes, Commissioner Gene Creighton – Yes, Commissioner Dennis Lopez – Yes.
c. Request for Approval of Sole Source Award of Use Agreement with Roosevelt County Community Development Corporation Regarding the Enterprise Center – County Manager Amber Hamilton stated this went out twice for RFP with no response. Motion to approve was made by Commissioner Gene Creighton with a second from Commissioner Dennis Lopez. Commissioner Paul Grider – Yes, Commissioner Gene Creighton – Yes, Commissioner Dennis Lopez – Yes.
d. Request for Approval of Agreement with GovernmentJobs.com Inc. dba NEOGOV To Provide Online Employment Application Services – Motion to approve was made by Commissioner Dennis Lopez with a second from Commissioner Paul Grider. e. Request for Approval of Program Agreement with New Mexico State University Cooperative Extension Service – Motion to approve was made by Commissioner Gene Creighton with a second from Commissioner Paul Grider. Executive Session:

At 10:10 a.m. motion was made by Commissioner Dennis Lopez to enter into Executive Session, Pursuant to 10-15-1 NMSA (1978) H (7) Attorney-client privileged information pertaining to threatened or pending litigation, specifically the County’s Opioid litigation, Hernandez vs. RC, McFarlin vs. RC, Aguilar vs. RC, Alonzo vs. RC (8) meeting for the discussion of the purchase, acquisition or disposal of real property or water rights by the public body, with a second from Commissioner Gene Creighton. Commissioner Paul Grider – Yes, Commissioner Gene Creighton – Yes, Commissioner Dennis Lopez – Yes.

Those in attendance were: Commissioner Paul Grider, Commissioner Gene Creighton, Commissioner Dennis Lopez, County Manager Amber Hamilton, and County Attorney Randy Knudson.

Motion was made by Commissioner Dennis Lopez to authorize county attorney to negotiate with the owner of 1320 N Boston for the purchase of real property adjoining Roosevelt county fairgrounds and road department, with a second from Commissioner Gene Creighton.
