The Roosevelt County Commission met in regular business meeting on Tuesday March 16, 2021 at 9:00 a.m. in the
Jake Lopez Community Building with those present being: Commissioner Rodney Savage, Commissioner Shane Lee,
Commissioner Tina Dixon, Commissioner Dennis Lopez, County Manager Amber Hamilton, County Attorney Randy
Knudson, County Clerk Mandi Park, Detention Administrator Justin Porter, GIS Technician Johnny Montiel, Road
Superintendent Ricky Lovato, Financial Specialist Liliana Rivera, Maintenance Director Gary Spinks, Sheriff Malin

Approval of Agenda:

Approval of Minutes:
Motion to approve minutes of the March 2, 2021 regular meeting was made by Commissioner Lopez with a second

Approval of Accounts Payable and Payroll:
Payroll from February 1, 2021 to February 28, 2021, payables from February 1, 2021 to February 28, 2021. Motion
to approve the payroll and payables for February 2021 was made by Commissioner Lopez with a second from
Commissioner Lee. Commissioner Lee-Yes, Commissioner Dixon-Yes, Commissioner Savage-Yes, Commissioner

Public Requests: Commissioner Dixon welcomed the public and reminded each speaker to limit their remarks to
three minutes and not repeat what previous speakers spoke about in order to allow everyone who would like to
speak, the opportunity to do so.
Meredith Eaton spoke about the Washington Lindsey home. She gave a short history of Mr. Lindsey’s many
accomplishments and expressed her disappointment that it will be sold at auction and removed from the land.
Brandon McAfee spoke about the windmill collection and expressed his disappointment that a portion of the
windmill collection will be sold at auction. He stated that his grandfather had spent many years collecting and
maintaining the collection prior to donating the windmills to the county.
Elected Officials/Department Heads Report:
Manager: Ms. Hamilton gave an in-depth update on legislation important to the County, New Mexico Counties,
local law enforcement and municipalities. There is one week left in the session, we are watching legislation that is
more likely to move forward. HB 4 is scheduled to be heard on the Senate Floor today. Ms. Hamilton stated all of
the resolutions passed by the Commission have been shared with our leaders in Santa Fe. The numerous cannabis
bills are moving through committees and both the House and Senate are trying to come to a compromise.
Roosevelt County continues to monitor Capital Outlay and bills affecting law enforcement. SB 376 has been
tabled. HB268 is headed to Senate Judiciary, which has 100+ bills to be heard. It will be a very fast pace for the
next 5 days prior to the end of the session at noon on Saturday.
Ms. Hamilton stated the second FEMA Application is in process. Ms. Rivera and Ms. Flores are working on the
application which will reimburse ($84,367.22). Ms. Hamilton stated that she is pleased the state has committed to
the Income Support Division having a continued presence in Roosevelt County. Ms. Hamilton gave and update on
the roof repairs projects. She is hopeful that all fairgrounds building repairs will be compete before fair time. She
also stated the last vehicle for repair is in the shop currently, bringing that total to about two million in insurance
repairs due to that August hail storm.
Commission: Commissioner Lopez asked if a new District Engineer had been hired by NMDoT and asked that
contact information for that person be shared with him. He asked about the Lime and Boston intersection project.
Ms. Hamilton stated the City of Portales has informed her that it is included in their budget, and expects that it will
be done prior to June 30th weather permitting.
Commissioner Lee asked Sheriff Parker to speak about the use of ATV and OHV on county roads. Sheriff Parker
asked Brandon Miller from Game and Fish to answer questions. Mr. Miller stated the rules for the state, county
and municipalities differ. What is allowed in a county, by adoption of an ordinance or resolution, may not be
allowed within the city limits and not allowed on state highways. He cautioned that most accidents involving OHVs
are operated by people under the age of 18. He also stated that even if approved in our county, the county would
have to petition the state for use on specific state highways. Commissioner Dixon asked about liability if allowed.
Sheriff Parker stated a county ordinance could be more restrictive than state law, but not less restrictive.
Resolutions – Ordinances – Proclamations :
A. Consideration of Resolution 2021-18 Annual Certified County Maintained Mileage: Mr. Lovato reported on the
certified mileage, noting that it is a living document, being changed and updated continually. Ms. Hamilton
stated there is currently 1208 miles in the county inventory. The roads within the Sagamore Project have all
been upgraded; and53 miles of road have been upgraded from dirt to caliche. Commissioner Lopez made a

B. Consideration of Resolution 2021-19 Adopting an Amendment to the Roosevelt County Detention Policies and
Procedures Manual: Mr. Porter stated the update to the policy was to include the tablet program. He also stated
the tablets have been a successful behavior modification tool. Detainees have access to libraries, self improvement programs, and a law library on the tablets. Commissioner Savage made a motion to adopt
Resolution 2021-19, with a second by Commissioner Dixon. Commissioner Lee-Yes, Commissioner Dixon-Yes,

Procurements – Contracts – Agreements:
A. Request for Approval of Submission of FY22 Law Enforcement Protection Funds Application by the Sheriff’s
Office: Sheriff Parker stated the LEPF Application provides $27,800.00 to the department. Commissioner Lopez
made a motion to approve the submission of the FY22 LEPF application with a second from Commissioner Lee.

B. Request for Approval of Memorandum of Understanding With the Administrative Office of the Courts and
Roosevelt County for Utilization of their Drug Information Management System for Court Compliance
Program: Ms. Hamilton stated both she and Mr. Knudson had reviewed the MOU. This software will be utilized
by the County’s Court Compliance program free of charge. A motion to approve the MOU was made by
Commissioner Lopez with a second from Commissioner Dixon. Commissioner Lee-Yes, Commissioner Dixon-Yes,

C. Request for Approval of Contract Renewal for the Purchase Crushed Caliche for the Road Department from
White Rock Crushing, LLC: Mr. Lovato stated he is happy with the contract with White Rock Crushing and asked
that the contract be renewed. A motion to approve the contract renewal was made by Commissioner Lee with a

D. Request for Approval of Memorandum of Agreement with the City of Portales, City of Clovis, City of
Tucumcari, County of Roosevelt, County of Curry, County of Quay and County of De Baca to Commission a
Feasibility Study for a Psychiatric Hospital in Clovis, New Mexico: Ms. Hamilton stated this was following
several months of meetings and conversations as we realize there is a significant need for inpatient behavioral
health services the cost to Roosevelt County of the feasibility study would be 9% or no more than $5,400.00
based on a total cost of $60,000. A motion to approve the MOU was made by Commissioner Lopez with a second

E. Request for Approval of Scope of Work with Behavioral Health Services Department and Roosevelt County for
RISE Project Funding for MAT Program at the Roosevelt County Detention Center: Mr. Porter stated the
purpose of the MAT program was to address drug and alcohol addiction among detainees and to assist them
with the transition from incarceration to continued services upon release to reduce recidivism. A motion to
approve was made by Commissioner Lee with a second from Commissioner Dixon. Commissioner Lee-Yes,

F. Request for Approval for Scope of Work with Behavioral Health Services Department and Roosevelt County
for MAT Program at the Roosevelt County Detention Center: A motion to approve was made by Commissioner

G. Request for Approval of Non-Client Agreement for Collaborative Member Agency Non-Medicaid Services with
Falling Colors Corporation and Roosevelt County for the MAT Program at the Roosevelt County Detention: A
motion to approve was made by Commissioner Dixon with a second from Commissioner Savage. Commissioner

H. Request for Approval of the Revised Roosevelt County Facility Agreement: Ms. Hamilton stated the agreement
was updated to include Covid safe practices are followed by those renting county owned facilities. County
facilities will be available for public rental beginning April 12, and will follow the NM PHO color designation. A
motion to approve was made by Commissioner Savage with a second from Commissioner Lee. Commissioner

I. Request for Approval of Re-Award of ITB 2021-02 Used Tractor for Road Department Next Lowest Bid to Bee
Equipment for a 2014 John Deere 8285R Totaling $110,000: Ms. Rivera stated that the vendor notified the
county that the previously awarded bid would not meet county specifications as it didn’t pass a mechanical
certification as required. She asked for approval to award the bid for the next lowest responsive bid. A motion to
approve was made by Commissioner Lee with a second from Commissioner Dixon. Commissioner Lee-Yes,

J. Request for Approval of Award of ITB 2021-03 Roosevelt County Health Center Roof Replacement to WWRC,
Inc. for $174,459.92: Ms. Rivera asked for approval of award for this project bid to the lowest bidder.
Commissioner Lee sought clarification of the funding source as it will be primarily capital outlay. Commissioner
Lopez made a motion to approve the award to WWRC Inc, with a second by Commissioner Lee. Commissioner

New Business:
A. Request for Approval of the Disposal of Miscellaneous Small Assets by Public Auction: A motion to approve of
the disposal of assets (as listed on attached spreadsheet) was made by Commissioner Lopez with a second from

B. Request for Approval of Disposal by Public Auction of One 2009 Ford F250 and One 2008 GMC Sierra from the
Road Department: Mr. Lovato stated the two old vehicles have been replaced in the road fleet. A motion to
approve of disposal at public auction was made by Commissioner Dixon with a second from Commissioner

C. Request for Approval to Invest $1,500,000 into the Moreton Capital Improvement Investment Fund and Up To
$1,000,000 into the Moreton General Fund Investment Account: Ms. Hamilton stated that Treasurer Sanchez
requested the approval of these investments. A motion to approve the investments was made by Commissioner
Dixon with a second from Commissioner Savage. Commissioner Lee-Yes, Commissioner Dixon-Yes, Commissioner

D. Inspection of the Show Arena Roofing Gutter System and Consideration of Two Repair Option: Members of the
commission and public walked over to the show arena to inspect and discuss the options for roof and gutter
repairs. Upon return to the Jake Lopez Building, commissioners discussed the options and costs. Commissioner
Lopez suggested a committee be formed to make a recommendation to the commission to make a betterinformed decision. Commissioner Lee made a motion to begin work on the poultry barn/show arena to install a
cricket system, at an additional cost of $17,000.00 with a second by Commissioner Savage. Commissioner LeeYes, Commissioner Dixon-Yes, Commissioner Savage-Yes, Commissioner Lopez-Yes. Commissioner Lee made a
motion to form a sub-committee to include at minimum Commissioner Lee, Gary Spinks, a representative from
the fair board and a licensed roofing contractor, to inspect and discuss the options for the hog barn/show arena
roof and gutter and make a recommendation to the commission at the next meeting A second was made by
