The Roosevelt County Commission met in regular business meeting on Tuesday July 11, 2023 at 9:00 a.m. in the County Commission Room with those present being: Commissioner Paul Grider, Commissioner Rodney Savage, Commissioner Tina Dixon, Commissioner Roy Lee Criswell, Commissioner Dennis Lopez, Assistant County Manager

1.Approval of Agenda: A motion to approve the agenda was made by Commissioner Lopez with a second from Commissioner Savage. Commissioner Grider-Yes, Commissioner Dixon-Yes, Commissioner Criswell-Yes, Commissioner Savage-Yes, Commissioner Lopez-Yes.
2.Approval of Minutes: A motion to approve the minutes from the June 20, 2023 regular meeting and the June 23, 2023 special meeting as corrected, was made by Commissioner Savage with a second from Commissioner Grider.

3.Public Requests: There were no public requests, however, Clerk Park provided a flyer and gave the dates for the poll official recruitment event to be held July 27, 2023 at 2:00 pm at the Jake Lopez Community Center.
4. Elected Officials and Department Heads Reports:
Detention: Ms. Ramsey reported the facility count at 53, with 32 male detainees and 21 female detainees, with 12 out-of-county detainees. She stated the June billing included: $3,740.00 billed to the Portales Police Department, $18,975.00 billed to Quay County, and $1,650.00 billed to Chaves County. Ms. Ramsey stated $342,264.00 has been paid out in juvenile housing costs through the end of June. She reported there are 9 participants in the MAT program with 2 participants receiving medication, 8 participating in group counseling and 1 in individual counseling. There is 1 participant in the GED Program. Ms. Ramsey stated RCDC staff and detainees with the help of the road department are putting up the greenhouse. The garden is started, and has some shade.
Ms. Ramsey stated there were no detainees in restrictive housing for the quarter, from April – June, 2023.
Roads: Mr. Lovato reported repairing wash-outs, pot-holes, and clogged culverts. He stated they have been working on cattle guards, shredding and tree trimming. On the LGRF projects, they are hauling caliche to Highlands, that project should be complete by July. The road department is also still working with the city on SRR 6, which should begin later this month and be complete in August. The micro-seal crew will be back in September to finish off each of the projects that are done by then. Mr. Lovato reported the concrete work at the food bank and EOC is complete. He stated the fence project at the fairgrounds has started with removing old fencing and setting posts for the new iron fencing. Commissioner Dixon asked about maintenance on SRR Y and SRR 20. Mr. Lovato stated operators are back on their routes after taking care of the storm damaged areas.
Commissioner Grider asked about SRR AP, Mr. Lovato state it would take about 2 weeks of work to make repairs and remove sand. The land owner will need to have a plan in place to prevent the sand from blowing again.
Commissioner Savage commended Mr. Lovato on his ability to tactfully and patiently deal with people. He also noted areas of illegal dumping. Mr. Lovato state he would have a dumping crew out next week. Commissioner Lopez asked if Curry County had any shared responsibility on SRR AP as it is a county line road. Mr. Lovato stated Roosevelt County maintains that North-south bound road and Curry County maintains the East-west bound county line road. He stated that has been the agreement as long as he has been around. Commissioner Lopez suggested Ms. Hamilton formalize a JPA with Curry County Manager Pyle.

Manager: Ms. Rivera asked to move the August 8th meeting to August 15th. Commissioners were agreeable to the move. Ms. Rivera stated the county would have a booth at Heritage days and asked for volunteers to man the booth. Commissioners discussed riding in the parade.
Commissioners: Commissioner Criswell asked why the fair board is charged rent for the fairgrounds. He felt like that money could be used by the fair board to improve the fair. He asked if we could possibly charge the fair board a single dollar instead of the $5000 fee. He requested that be placed on a future agenda for consideration.
Commissioner Lopez stated the county has invested heavily in improvements to the fairgrounds over the last decade and is pleased with the improvements. Commissioner Savage stated there has been a foundation created in support of youth in agriculture, in honor of Joyce Cone. The Ma Cone Foundation will provide local youth with funding and support for participation in ag related activities and programs. The first fundraiser for the foundation is set for September 23, 2023. It will be a steak dinner with entertainment provided by the Delk Band and tickets are available now. Commissioner Lopez stated he was invited to do a statewide radio interview on mental health and homelessness. The broadcast will be at 9:00 am on Thursday morning.
5. New Business:
A. Request for Approval of a Type 3-B Summary Subdivision Replat of 6-7-8 of Mesa Addition Block 14 in the City of Portales and of Roosevelt County: Mr. Montiel stated the subdivision replat requested by Nathan Dodge, is within the city limits in the Mesa Subdivision and has met all of the requirements of the subdivision ordinance, had no adverse opinions from utilities or neighboring land owners and has been approved by the City of Portales. Commissioner Lopez made a motion to approve the subdivision replat as presented with a second by Commissioner Savage. B. Request for Approval of a Type 3-B Summary Subdivision Replat of 6-7-8-9 & 10 of Mesa Addition Block 10 in the City of Portales and of Roosevelt County: Mr. Montiel stated Garrett Hatch requested the replat of lots 6-10 of Block 10 of the Mesa Subdivision. There were no adverse opinions, all requirements have been met, and the request has been approved by the city council. Commissioner Savage made a motion to approve the replat as requested with a second by Commissioner Criswell. C. Request for Approval to Provide the City of Portales with Notice of Detention Billing Requirements: Ms. Rivera stated the County would like to bill the city for detention services. Commissioner Dixon stated she had spoken with legal at New Mexico Counties and there is no law stating the counties cannot bill municipalities for detention services. Mr. Garcia stated the billing should include an itemized invoice with reasonable fees. Mr. Garcia noted there is an opinion from the office of the Attorney General supporting the City’s position on the subject, however the opinion is not supported by case law. After some discussion of services provided and fair market value of those services, Commissioner Grider made a motion to approve the billing as requested with a second by Commissioner Savage. D. Discussion and Update Regard the Sagebrush Sand Dune Lizard: Commissioner Dixon gave an update on the listing of the lizard, stating the EPA wants to add the Sagebrush Sand Dune Lizard to the Endangered Species List. She stated there are hundreds of acres already in conservation programs. She stated the 60-day comment period is currently open and requested that Roosevelt County submit written comment.
Commissioner Criswell made a motion to allow Ms. Dixon to write and submit comment opposing the listing of the Sagebrush Sand Dune Lizard as requested with a second by Commissioner Grider. Commissioner Grider-Yes,

6.Resolutions – Ordinances – Proclamations:
A. Consideration of Resolution 2023-22 Revisions to the Roosevelt County Travel and Per Diem Policy: Ms. Rivera presented the updated travel and per diem policy, stating the changes include an increase to the daily allowable rate for food and increases the per diem and milage rates to match the rates set by the state. She stated there are updated forms to reflect the updated policy and amounts. Commissioner Savage made a motion to approve the revised policy, with a second by Commissioner Lopez. B. Consideration of Resolution 2023-28 Reinstatement of the Hiring and Referral Incentive Program: Ms. Bagwell stated the vacancy rates at both Detention and the Sheriff’s Office have gone down significantly since adopting the incentive program. She also stated funding for the incentives was included in the budget.

C. Consideration of Resolution 2023-29 Roosevelt County Volunteer Fire Departments Nominal Fee
Stipend Program Policy: Ms. Rivera gave an overview of the stipend policy and shared the proposed rates. The rate chart is included in the resolution. D. Consideration of Resolution 2023-30 Notice of Regular Local Election to be Held Nov. 7, 2023: Clerk Park stated the resolution is to inform the public and the Secretary of State’s Office what content will be on the November ballot. She stated she had received notification from all school districts, municipalities, the hospital and the soil and water conservation districts of their open positions. She stated the city of Portales opted in on June 13, 2023 and the town of Elida is set to vote on their ordinance on July 12, 2023. Commissioner Lopez made a motion adopt the resolution as recommended by Clerk Park, with a second by Commissioner Grider.

E. Consideration of Resolution 2023-31 Adopting an Amendment to the Roosevelt County Detention
Policies and Procedures Manual and Annual Review: Ms. Ramsey stated there are minor changes to the
verbiage to satisfy accreditation. Those changes are in the restraint, in-take and environmental sections.
Commissioner Lopez congratulated Ms. Ramsey and her staff on their re-accreditation. Commissioner Dixon made a motion to adopt the resolution, with a second by Commissioner Criswell. 7.Contracts – Agreements – Procurements:
A. Request for Approval of RISE Grant Award of $339,600 from the NM Behavioral Health Services Division for the Roosevelt County Detention Center MAT Program: Ms. Paulus requested the approval of the RISE grant. Commissioner Lopez made a motion to approve the grant award, with a second by Commissioner Criswell. B. Request for Approval of Federal SOR 2020 Grant Funds Carry-forward of $22,875.62 for the Roosevelt County Detention Center MAT Program: Ms. Paulus requested the award of the additional funds from the State Opioid Response program. Commissioner Grider made a motion to approve the grant, with a second by Commissioner Lopez. C. Request for Approval of Professional Services Agreement with Carolina Martinez for Peer Support
Services within the MAT Program at the Roosevelt County Detention Center: Ms. Paulus requested approval of the agreement with Ms. Martinez. Commissioner Lopez made a motion to approve the agreement, with a second by Commissioner Dixon. D. Request for Approval of Detainee Confinement Agreement with San Miguel County: Ms. Rivera provided the detainee confinement agreement. She stated the agreement is new, as we have not house detainees from San Miguel County, however it is very similar to confinement agreements with other counties. After some discussion on safety, security and detainee screening, Ms. Ramsey assured the commission that she has the right to refuse any detainee, as well as the right to return any detainee for any reason. Commissioner Grider made a motion to approve the agreement, with a second by Commissioner Dixon. E. Request for Consideration of Representation and Access Agreements between Roosevelt County and
Singleton Schreiber, LLP: Mr. Parker stated the access agreement gives Singleton and Schreiber, LLP the authority to test the water wells owned by the county for PFAS contaminants. Mr. Garcia stated he had July 11, 2023 reviewed the agreements and did not have any issues with them. Commissioner Criswell made a motion to approve the agreement as requested, with a second by Commissioner Dixon. F. Request for Consideration of Subscription Agreement for TextMyGov: Ms. Park gave an overview of the TextMyGov program and how it will help the public find information and report issues.
