The Roosevelt County Commission met in regular business meeting on Tuesday July 27, 2021 at 9:00 a.m. in the
County Commission Room with those present being: Commissioner Tina Dixon, Commissioner Dennis Lopez,
Commissioner Shane Lee, Commissioner Paul Grider, Commissioner Rodney Savage, County Manager Amber
Hamilton, County Attorney Randy Knudson, County Service Specialist Silke Humpe, County Treasurer Layle
Sanchez, County Assessor George Beggs, County Assessor Deputy Stevin Floyd, GIS Coordinator Johnny Montiel,

1.Approval of Agenda:
A motion to approve the agenda was made by Commissioner Dixon with a second from Commissioner Lee.

2.Approval of Minutes:
Motion to approve minutes of the July 6, 2021 regular meeting was made by Commissioner Lopez with a second

Commissioner Lee-Yes, Commissioner Lopez-Yes. Motion to approve minutes of the ICIP Input Meeting on July

Motion to approve minutes of the ICIP Input Meeting on July 21, 2021 was made by Commissioner Lee with a

3.Approval of Accounts Payable and Payroll:
A motion to approve accounts payable and payroll from June 1, 2021 through June 30, 2021 was made by
Commissioner Lopez with a second from Commissioner Dixon. Commissioner Grider-Yes, Commissioner DixonYes, Commissioner Savage-Yes, Commissioner Lee-Yes, Commissioner Lopez-Yes.
4.Public Requests:
Leon Nall, Wade Fraze and Will Banister thanked the Commission for putting their request to change the
commission meeting time on the agenda and proposed various reasons why it would benefit the people of this
community who are unable to attend or consider running for a position as a Commissioner due to the time of
the meetings.
5. Elected Officials/Department Heads Report:
Treasurer: Ms. Sanchez stated that 97% of the 2020 taxes has been collected so far and the State Auditors for
delinquent taxes were coming this week. She also presented the report for May 2021, with the general fund
beginning cash balance of $3,410,854.24, increases (debits) of $1,465,937.01, and decreases (credits) of
$713,102.95, ending the general fund cash balance with $4,163,688.30.
Indigent Healthcare: Commissioner Lopez made a motion to go into Indigent Meeting at 9:12 with a second
from Commissioner Lee. Commissioner Dixon-Yes, Commissioner Lopez-Yes, Commissioner Grider-Yes,
Commissioner Lee-Yes, Commissioner Savage-Yes. Ms. Acosta-Flores announced that the county had 48 claims
totaling $26,278.52 submitted and she recommended 43 for approval with an amount of $17,952.62 and 5
claims being rejected for not meeting the deadline or not being a detainee at the time. Commissioner Lee made
a motion to come out of indigent meeting with a second from Commissioner Dixon. Commissioner Grider-Yes,

Commissioner Lee made a motion to accept the indigent report with a second from Commissioner Grider.

Commissioner Lopez-Yes. Ms. Acosta-Flores stated that she would like to present the FY 21 Annual Report and a
motion was made by Commissioner Lopez to go back into indigent meeting with a second from Commissioner
Dixon. Commissioner Grider-Yes, Commissioner Dixon-Yes, Commissioner Savage-Yes, Commissioner Lee-Yes,
Commissioner Lopez-Yes. Ms. Acosta-Flores presented the numbers for July 2020 through June 2020 with a
grand total of approved claims of $47,084.48. Commissioner Lopez made a Motion to come out of Indigent
Meeting at 9:14, with a second from Commissioner Savage. Commissioner Grider-Yes, Commissioner Dixon-Yes,
Commissioner Savage-Yes, Commissioner Lee-Yes, Commissioner Lopez-Yes. Ms. Acosta-Flores discussed the ICIP
Development Plan and that notices were sent out for two public meetings to be held on July 14th and July 21st
.
No community member was present for either meeting. Currently Ms. Acosta- Flores is working on a draft for
different projects that have come in and she is planning on putting these on the ICIP Development Plan and
present the draft in August. She will present the final draft in September before the deadline.
Manager: Ms. Hamilton stated that the scheduled meeting for the 5 year road plan that followed the ICIP
meeting was also unattended by the public. Superintendent Ricky Lovato will present a redraft of the plan at the
next commission meeting. She suggested a possible work session during a regular meeting regarding the 5 year
plan. The crew of the road department is busy getting weeds shredded and maintaining the roads. Ms. Hamilton
shared that she had attended the Fair board meeting and gave updates of the projects on the fairgrounds and
announced that the county is considering having an active workday on August 10th for county employees to
participate in the cleanup of the fairgrounds.
Commission: Commissioner Lopez asked the Commission to keep pursuing the enhancement of the fence.
Manager Hamilton stated that there is no allowance of federal funds for the fence but she will continue to
search for other funding to replace the fence. Commissioner Lee and Commissioner Dixon received a phone call
from a citizen regarding maintenance of Road X. Manager Hamilton explained that no blades are available at this
time but the road crew will get to it quickly. Commissioner Savage has concerns regarding the PED’s potential
requirement to include critical race theory in the school’s curriculum. He stated that he also attended the Fair
board meeting and learned that a fan for the pavilion has been donated to the county. He inquired where the
funds for the installation and maintenance of the fan will be coming from. He expressed his concerns regarding
gifts and where the gifts are from. Manager Hamilton informed the Commission that the fan had been donated
to the fair board by Coca-Cola. The installation needs to be done by a licensed electrician.
6.New Business:
a. Request for Approval of Potential Building Modification to the Roosevelt County Health Clinic if Awarded
Grant Funding. Mr. Seferino Montano announced the possibility of an optometry clinic and announced that a
proposal for funding has been submitted. He explained that the only Optometrist in town has retired and the
community would benefit from a local eye doctor. Commissioner Lees asked how it would affect the county’s
budget in the future and if the Optometry would carry the insurance and liability of the business. Mr. Montano
confirmed this. A motion was made for the Approval of Potential Building Modification to the Roosevelt
County Health Clinic if Awarded Grant Funding by Commissioner Lopez with a second by Commissioner Lee.

b.Discussion and Consideration of Meeting Time Change – Commissioners
After discussion among the members of the Board, the Commission requested Manager Hamilton to survey
department heads and elected officials regarding the potential time change. The subject was tabled until the
August 10th meeting.
7.Resolution – Ordinances – Proclamations
a. Consideration of Resolution 2021-37 4th Quarter-Part III Final Budget Adjustment – Liliana Rivera.
Commissioner Lee made a motion to approve the 4th Quarter-Part III Final Budget Adjustment with a second
by Commissioner Lopez. Commissioner Grider-Yes, Commissioner Dixon-Yes, Commissioner Savage-Yes,
Commissioner Lee-Yes, Commissioner Lopez-Yes.
b.Consideration of Resolution 2021-38 Fiscal Year 4th Quarter Final Report – Liliana Rivera. Commissioner Savage
made a motion to approve the Fiscal Year 4th Quarter Final Report with a second by Commissioner Grider.

Motion was made to go into Public Hearing regarding 2021-22 Fiscal Year Budget by Commissioner Dixon at
10:06 with a second by Commissioner Lee. Commissioner Grider-Yes, Commissioner Dixon-Yes, Commissioner
Savage-Yes, Commissioner Lee-Yes, Commissioner Lopez-Yes. There were no comments or concerns from the
present community members. A motion was made to come out of Public Hearing at 10:06 by Commissioner
Lee with a second from Commissioner Savage. Commissioner Grider-Yes, Commissioner Dixon-Yes,
Commissioner Savage-Yes, Commissioner Lee-Yes, Commissioner Lopez-Yes.
c. Consideration of Resolution 2021-39 2021-2022 Fiscal Year Budget Adoption-Liliana Rivera. Commissioner Lee
made a motion to approve the 2021-39 2021-2022 Fiscal Year Budget Adoption with a second by
Commissioner Savage. Commissioner Grider-Yes, Commissioner Dixon-Yes, Commissioner Savage-Yes,
Commissioner Lee-Yes, Commissioner Lopez-Yes.
d.Request for Approval of Notice of Intent for Consideration of Ordinance 2021-03 An Ordinance Regulating the
Time, Place and Manner of Cannabis Sales, Manufacturing and Consumption-Randy Knudson/Amber
Hamilton/Commissioners. Manager Hamilton explained that a lot of the counties are considering having an
ordinance to establish some regulations. County Attorney Knudson presented a draft of the Ordinance to
regulate the time, place and manner of cannabis sales, manufacturing and consumption. The details of the
state regulations are unknown at this time but he was asking the Commission to give intent to publish this
Ordinance. After discussion among the members of the Board Commissioner Lopez made a motion to
approve the Notice of Intent for Consideration of Ordinance 2021-03 with a second from Commissioner
Savage. Commissioner Grider-Yes, Commissioner Dixon-No, Commissioner Savage-Yes, Commissioner LeeYes, Commissioner Lopez-Yes. With one descending vote the motion passed.
8.Procurements – Contracts – Agreements:
a. Request for Approval of Memorandum of Understanding Between the New Mexico Secretary of State and
Roosevelt County – Amber Hamilton. A motion to approve the Memorandum of Understanding Between the
New Mexico Secretary of State and Roosevelt County was made by Commissioner Lee with a second from
Commissioner Lopez. Commissioner Grider-Yes, Commissioner Dixon-Yes, Commissioner Savage-Yes,
Commissioner Lee-Yes, Commissioner Lopez-Yes.
b.Consideration of Agreement and Hold Harmless with Billy Jack & Mary Lou Moore for Road Maintenance of
South Roosevelt Road 30 ½ – Amber Hamilton. A motion to approve the Agreement and Hold Harmless with
Billy Jack & Mary Lou Moore for Road Maintenance of South Roosevelt Road 30 ½ was made by Commissioner
Dixon with a second from Commissioner Savage. Commissioner Grider-Yes, Commissioner Dixon-Yes,
Commissioner Savage-Yes, Commissioner Lee-abstain, Commissioner Lopez-Yes. The motion carried.
c. Consideration of Project Change Order for Storm Water Drainage Project – Amber Hamilton. Motion to
approve the Project Change Order for Storm Water Drainage Project was made by Commissioner Lee with a
