NOTICE OF PUBLIC MEETING
CITY COUNCIL, CITY OF PORTALES, NEW MEXICO
THE PUBLIC IS INVITED TO ATTEND THE PORTALES CITY COUNCIL’S MEETING TO BE HELD at 5:30 p.m., on Tuesday, December 12, 2023, in the Council Chambers in the Memorial Building, at 200 E. 7th Street, Portales, New Mexico. The following item(s) is/are scheduled for consideration and action by the City Council:

AGENDA
I. CALL TO ORDER – MAYOR/MAYOR PRO-TEM/COUNCILOR-AS-CHAIR.
II. ROLL CALL – CITY CLERK.
III. INVOCATION & PLEDGE OF ALLEGIANCE.
IV. OFFICIAL SALUTE TO THE NEW MEXICO FLAG: “I salute the flag of the State of New Mexico the Zia symbol of perfect friendship among united cultures.”
V. PUBLIC COMMENT – The Public has the opportunity to provide comment on any subject during the public comment period. Speaker’s comments will be limited to three (3) minutes unless Mayor and/or Councilor(s) requests more information. The time limit is given in an effort to allow public input but also to move the agenda forward in a prompt yet efficient manner.
All Speakers must sign in at the beginning of the Meeting. Topics are limited to six (6) speakers per topic.

EMERGENCY MANAGER – A. Brezovsky, EM/RM
1. Request For Approval for The Hazard Mitigation Assistance Grant 4529-0005-NM In the Amount Of
$84,000.20 With A Match Of $8,000.20 Which Will Be Split Equally Between the City and Roosevelt County.
The Grant Will Be Used for Advertising, Travel, Supplies and Other Hazard Mitigation Needs. The Project
is Expected to Be Approximately 18 Months for Implementation and The Resulting Plan Will Be Valid for
Four (4) Years.

FIRE DEPARTMENT – Fire Chief Cathey
1. Portales Fire Department Is Seeking Council’s Approval for The FY25 Trauma System Development
Project Grant to Purchase a Training Mannequin with Advanced Trauma Kit with Quoted Price $23,547.99.

COMMUNITY SERVCES – K. McClellan, C. S. Director
1. Approval of Recommendation for Resolution NO. PC-2023-2024-14 For A Special Use Permit at The
Address of 1320 N Kilgore Which Would Allow for An Expansion of The Cemetery into The Land South of
The Current Cemetery.
2. Approval of Recommendation for Resolution NO. PC-2023-2024-15 For A Special Use Permit at The
Address of 105 N Ave I Which Would Allow for The Addition of Antennas for Radio Transmissions to An
Existing Tower.
3. Approval of Recommendation for Resolution NO. PC-2023-2024-16 For A Special Use Permit at The
Address of 1001 N Chicago Which Would Allow for The Sale of Alcohol on The Property. This Property
Previously Held a Liquor License.
4. Approval of Recommendation for Resolution NO. PC-2023-2024-17 For A Vacation of Right-Of-Way for a
Platted but Undeveloped Road Known As “East Canadian St” Lying Between Lots 13 And 14 of Block 4 and
Lots 19 Through 24 of Block 7 of The Franklin Addition Which Will Allow for The Property Owner on
Either Side to Take Half of This Land. One Property Has Been Overbuilt onto This Right-of-Way and This
Will Help to Adjust the Property Lines.
5. Approval Of Recommendation for Resolution NO. PC-2023-2024-18 For A Variance At 903 N Ave 0 Which
Would Allow for A Community Solar Project to Be Built on The Property.

4. Request for Approval for City of Portales to Transfer Real Property Located at 100 W First Street Portales,
NM 88130 to Roosevelt County Community Development Corporation (RCCDC), pursuant to terms of the
Project Participation Agreement by Roosevelt County Electric Cooperative (RCEC), by way of Inducement
Resolution # 23-24-26.
5. LEDA Application, Enchantment Vineyard Application.

CITY COUNCIL
1. City Council Appointment of Mayor for Term 2024-2026. Per NM Statute: 2021 New Mexico Statutes
Chapter 3 – Municipalities Article 11 – Mayor-Council Municipality; Mayor Section 3-11-2 – Mayor;
Vacated Office; Appointment by Governing Body. Universal Citation: NM Stat § 3-11-2 (2021) In Case of
The Death, Disability, Resignation or Change of Residence, From the Municipality, of the Mayor, The
Governing Body Shall Appoint by Majority Vote a Qualified Elector to Fill the Vacancy for The Unexpired
Term of Office.
Resigning Mayor Authorized to Cast Tie-Breaking Vote. — Since It Is Contemplated That the City Council’s
Action in Selecting a Resigning Mayor’s Successor Would Be Taken Before the Effective Date of The Former’s
Resignation, The Resigning Mayor Would Be Authorized to Cast a Deciding Vote in The Event of a Tie on The
Choice of a Successor.

IX. EXECUTIVE SESSION – R. Jackson, Mayor
a. Action to Convene in a Closed Meeting to Discuss Matters as Provided for Under New Mexico
Statutes Relating to Limited Personnel Matters Re: City Manager, and Matters Pertaining to
Attorney Client Privileged Information, and Relating to the Purchase, Acquisition, or Disposal of
Real Property or Water Rights.
b. Action to Convene in Open Session.
c. Action As a Result of the Closed Session.
